Terms of Service

By accessing or using Whiskit, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the service.

You must be legally capable of entering into a binding agreement to use Whiskit. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, including any unauthorized access resulting from your failure to safeguard your credentials.

You may use Whiskit only in compliance with these terms and applicable law. You agree not to:

• Attempt to access another user's account or data without authorization
• Interfere with or disrupt the operation of the service
• Upload malicious code, harmful content, or abusive material
• Use the service for unlawful, fraudulent, or deceptive purposes
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of Whiskit
• Scrape, crawl, or extract data from the service using automated means or manual processes for any purpose not expressly permitted
• Copy, replicate, or build products that reproduce Whiskit's specific code, visual design, branding, or proprietary content without authorization
• Use any content, data, outputs, or features of Whiskit to train, fine-tune, evaluate, or develop artificial intelligence or machine learning models
• Redistribute, sublicense, sell, resell, or commercially exploit any part of the service or its content without prior written permission from Frost & Fable Studios, Inc.
• Remove, obscure, or alter any proprietary notices, branding, or attribution present in the service

You retain ownership of the recipes, pantry information, images, and other content you create or upload to Whiskit. By submitting that content, you grant us a limited, non-exclusive, royalty-free right to host, store, process, transmit, display, and make available that content solely as needed to operate, maintain, and improve the service.

If you choose to make a recipe public within Whiskit, you additionally grant other users of the service a limited right to view, save a copy of, and use that recipe within the app for their personal, non-commercial purposes. This is how public recipe sharing and the recipe copy feature work, and by making a recipe public you are consenting to that use. You may remove a recipe from public visibility at any time, which will stop future sharing but will not retroactively remove copies already saved by other users.

We do not review, verify, or guarantee the accuracy, safety, legality, or quality of user-submitted content. Users are solely responsible for any content they create or share through Whiskit.

Whiskit, its name, logo, branding, interface elements, design, code, text, graphics, service structure, and all related intellectual property are owned by or licensed to Frost & Fable Studios, Inc., except for user content that belongs to its respective creators. These terms do not transfer any ownership rights to you.

You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, transmit, or otherwise exploit any part of Whiskit — including its visual design, feature structure, or application content — without prior written permission from Frost & Fable Studios, Inc. Unauthorized use of Whiskit's intellectual property, including its code, branding, or design, may constitute infringement and could result in legal liability under applicable law.

You are granted a limited, revocable, non-exclusive, non-transferable license to access and use Whiskit solely for your personal, non-commercial use in accordance with these terms. This license does not include any right to sublicense, resell, or commercially exploit any part of the service.

We may update, improve, suspend, or discontinue any part of Whiskit at any time, with or without notice, including features, integrations, pricing structures, access methods, public-posting functionality, moderation tools, and subscription benefits. We aim to build for the long term, but we do not guarantee uninterrupted availability.

We reserve the right to suspend or terminate access to Whiskit if you violate these terms, misuse the service, engage in fraud or abuse, or create risk or harm for other users or for the platform itself.

Upon termination, your right to use the service ceases immediately. The following sections survive termination and remain in full effect: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Dispute Resolution, and any other provisions that by their nature should survive.

Whiskit is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

To the fullest extent permitted by law, Frost & Fable Studios, Inc. and its affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or business interruption, arising out of or related to your use of Whiskit — including any reliance on nutritional information, ingredient matching, pantry suggestions, substitutions, allergen-related assumptions, user-generated content, moderation decisions, or recipe content displayed in the app.

To the fullest extent permitted by law, our total liability to you for any direct damages arising out of or related to these terms or your use of Whiskit will not exceed the greater of (a) the total amount you paid to Frost & Fable Studios, Inc. for access to Whiskit in the twelve months preceding the claim, or (b) ten US dollars ($10.00). If you have not made any payments, our total liability is limited to ten US dollars ($10.00).

You agree to indemnify and hold harmless Frost & Fable Studios, Inc. from and against claims, liabilities, damages, losses, and expenses arising from your misuse of the service, your violation of these terms, your submitted content, or your infringement of another party's rights.

These Terms of Service are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles, except where applicable local consumer protection law requires otherwise.

Whiskit respects intellectual property rights. If you believe that content available through Whiskit infringes your copyright, you may submit a takedown notice to us at support@frostfablestudios.com including: a description of the copyrighted work, the location of the infringing content in the app, your contact information, a statement of good faith belief that use is unauthorized, and a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.

We will respond to valid notices in accordance with applicable law and may remove or disable access to infringing content at our discretion.

We may update these Terms of Service from time to time. If we make changes, we will update the "Last updated" date above. For material changes, we will make reasonable efforts to provide additional notice, such as an in-app notification. Continued use of Whiskit after changes become effective constitutes acceptance of the revised terms.
